[EB1] [EB1] Multinational Manager’s Green Card Approved 08/02/2019

This client is a general manager who has been working for a U.S. subsidiary office in L-1 visa status for the past couples of years. The company decided to sponsor her green card under EB-1C preference category, which is faster than other EB-2 or EB-3 categories, because the PERM labor certification is waived in EB-1C. To qualify, there are multiple requirements to be demonstrated: (1) a qualifying relationship between the foreign company and the U.S. company which must have been conducting business in the U.S. for at least one year ; (2) that the beneficiary had worked as an executive or a manager for the foreign company for at least one year; (3) that the proposed position in the U.S. company is executive or managerial; and (4) the U.S. company’s ability to pay the offered salary. Given the heightened scrutiny in EB-1 cases these days, it is especially important to prepare full documents to demonstrate the beneficiary’s previous overseas position as well as the proposed position in the U.S. We have submitted substantial evidence satisfying these requirements, and our client and his family members received their green cards immediately following the adjustment interview.
